TERMS AND CONDITIONS

OF PLATFORM USE AND DATA CONSENT

This Terms of Use of the Platform and Data Consent (“Term”) aims to clarify and determine the USER of the institutional website of FICAR DE BEM; to the USER interested in registering as a donor on how to use the platform and register donations, including users who also contribute content, information and other materials or services, as well as their rights and responsibilities as a USER and the conditions of data protection and privacy in the consent and sharing of personal data for registration on the platform.

FICAR DE BEM is a non-governmental, non-profit organization, declared to be of Municipal, State and Federal Public Utility and which works in the area of Social Assistance in the Advice, Defense and Guarantee of Rights.

The objective of the NGO FICAR DE BEM is to promote the prevention, care and protection of children and adolescents with violated rights, aiming at the maintenance of physical, psychological and social well-being, according to the principles established by Law nº 8069/90 – Statute of Children and Adolescents (ECA) and the Unified Social Assistance System (SUAS).

FICAR DE BEM reserves the right, at its sole discretion, to modify or replace any provision of this Term, as well as to change, suspend or discontinue the service, at any time, through a notice made available on the Site or other means of communication. in writing.

FICAR DE BEM may also impose limits on certain features and services or restrict your access to parts or all of the Site, without notice or liability, and the USER is responsible for checking the Terms of Use periodically. Your continued use of the Site or donation platform following the posting of any changes to the Terms of Use constitutes acceptance of those changes.

As a condition of use, the USER promises not to use the Site or the Platform for any unlawful, illegal, immoral purpose or that is prohibited by this Term.

All documents, materials and/or content made available by FICAR DE BEM to users or its partners are provided for your own personal and non-commercial use only.

The USER is responsible for all his/her activity and operations carried out on the Platform with his/her personal data, and when using the Website or the Platform of FICAR DE BEM, the USER undertakes not to produce, make available or share any data, information or content that:

It involves the practice of an illicit act and violates current Brazilian legislation;

Violate the rights of third parties or the rights of FICAR DE BEM;

Threatening, coercing or embarrassing third parties related to FICAR DE BEM;

Is false, incorrect, inaccurate, extemporaneous and that may mislead others;

Provide or allow access to illegal, violent, pornographic content or any other act contrary to law and public order;

Induce discrimination or incite hatred against people and/or groups of people on grounds of nationality, race, religion, sexual orientation, gender, physical condition, nationality, among other acts that contravene public order and current Brazilian legislation;

It is protected by a third party's intellectual property right and the customer does not have prior authorization to use it;

Contains a virus or other element that is capable, due to its characteristics (such as shape, extension, etc.), of causing damage or preventing the regular operation of the platform network and/or computer equipment ("hardware" and "software" ) by FICAR DE BEM or third parties; and

Use any measures to prevent or restrict access to the Platform or to other accounts, computer systems or networks connected to the Platform.

As long as the USER enjoys the Website or Platform of FICAR DE BEM, the USER will be responsible and exempt from any liability when:

For any act, action or omission that may be practiced and that are directly or indirectly linked to the activities of the NGO FICAR DE BEM and its partners;

For the repair of damages caused to third parties, to FICAR DE BEM or its partners;

If it is found that the institutional website and other platforms have been used or violated by unauthorized third parties, as well as problems arising from procedures such as hacking, cracking, crawler, mashups and others that have been proven to have been caused or induced by the USER.

The USER's data and information collection and verification activities may be temporarily suspended for possible maintenance of the services, software and search engines used in the activities.

In order to carry out the activities of FICAR DE BEM and according to the interests of the USER, the USER authorizes the collection of data and information by FICAR DE BEM and its partner companies, at the time of registration of the data by the USER or by legitimate external sources, with due legal or contractual basis, as well as the treatment, storage and sharing of their data and information necessary to achieve the purpose.

Any other data and information necessary to carry out the activities may be requested according to the demands and will automatically be subject to the consent declared herein and the Privacy Policy in force at the time.

As the data controller under the terms of the legislation, in addition to the authorization granted by the USER, FICAR DE BEM may share data and registration information with other companies affiliated with it, with companies under direct control, or indirectly from it, with professionals authorized to manage and administer the contracts and with legal, accounting and tax advice, always in strict compliance with the Law to:

ensure greater security and prevent fraud;

ensure their proper identification, qualification and authentication;

prevent acts related to money laundering and other illicit acts;

improve the care and services offered to society;

for the due fulfillment of legal obligations;

for the regular exercise of rights.

FICAR DE BEM may also use the data, information and means of contact provided by the USER to send advertising, communication, newsletter, mailings, whether by email, SMS, transmission list or other means of communication, which he/she hereby declares his/her acknowledgment and agreement.

On the other hand, the USER may, at any time, request the cancellation of receiving such communications, including by e-mail comunicacao@ficardebem.org.br and FICAR DE BEM undertakes to stop sending communicated in the shortest possible time, provided that such interruption does not impair the regular progress of the activities to be provided.
